A judge has overruled a jury’s $93.6m award to ICTSI from the ILWU, over work slowdowns at Portland. The award was reduced to $19m – “the maximum amount sustainable by the proof”. The judge said that an expert witness for ICTSI had “grossly inflated” the economic harm caused, by inflating ICTSI’s baseline shipping volume, and assuming that ICTSI would have been able to raise prices per container and increase shipping volume, according to nwlaborpress. However, the new award will still be hard to raise, amounting to just shy of $500 for each member.
